<br />EXHIBIT B <br /> <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF MIKE RENQUlST <br />FOR PLANNED UNIT DEVELOPMENT MAJOR MODIFICATION, AS FILED <br />UNDER CASE PUD-OI-09M <br /> <br />WHEREAS, Mike Renquist has applied for a major modification to an approved Planned Unit <br />Development (PUD) to increase the maximum building height from 23 feet to <br />26 feet, to allow a barrel tile roof, and to allow design review approval by the <br />Planning Director for a single lot located at 2511 Yolanda Court in the Vineyard <br />Avenue Corridor Specific Plan area; and <br /> <br />WHEREAS, zoning for the property is PUD-LDR (Planned Unit Development -Low Density <br />Residential) District; and <br /> <br />WHEREAS, the environmental review for this proposed project was undertaken with an Initial <br />Study Mitigated Negative Declaration approved by the City Council for PUD-Ol <br />on March 6, 2001, in conformance with the standards of the California <br />Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, there are no substantial changes to the project or to the circumstances under which <br />the project is being undertaken that involve new significant environmental effects <br />or that substantially increase the severity of previously identified effects; <br />furthermore, there is no new information of substantial importance which was <br />unknown at the time that the Mitigated Negative Declaration was approved by the <br />City Council regarding the project or its effects, mitigation measures, or <br />alternatives; and any previously identified effects or impacts are mitigated to a <br />level of insignificance with the mitigation measures incorporated into the project's <br />design or imposed on the project pursuant to the conditions of approval; and <br /> <br />WHEREAS, at its meeting of October 25, 2006, the Planning Commission recommended <br />approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on December 5, 2006; and <br /> <br />WHEREAS, the City Council finds that the PUD major modification is consistent with the <br />General Plan policies and the purposes of the PUD ordinance of the City of <br />Pleasanton; and <br />
