<br />RESOLUTION NO. 06-062 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, CALIFORNIA, <br />UPHOLDING THE ZONING ADMINISTRATOR'S APPROVAL OF THE APPLICATION OF <br />ROBERT SWEENEY CONSTRUCTION, FOR JIM RHOADES, FOR ADMINISTRATIVE <br />DESIGN REVIEW APPROVAL, AS FILED UNDER CASE PADR-1542 <br /> <br />WHEREAS, Robert Sweeney Construction, for Jim Rhoades, has applied for <br />administrative design review approval to construct an approximately 1,224-square-foot <br />second-floor addition and an approximately 120-square-foot first-floor addition to the front of the <br />existing residence located at 3227 Anastacia Court; and <br /> <br />WHEREAS, zoning for the property is R-1-7,500 (Single-Family Residential) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, Steve and <br />Carol Stanton submitted an appeal (Case PAP-97) of the Zoning Administrator's approval; and <br /> <br />WHEREAS, at its meeting of July 26, 2006, the Planning Commission, after having <br />considered all public testimony, relevant exhibits, and recommendations of City staff concerning <br />this application, denied the appeal, thereby upholding the Zoning Administrator's approval; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the appellants <br />submitted an appeal (Case PAP-98) to the Planning Commission's decision; and <br /> <br />WHEREAS, at its meeting of September 5, 2006, the City Council received a report from <br />the Director of Planning and Community Development, together with a copy of the staff report to <br />the Planning Commission, regarding this matter; and <br /> <br />WHEREAS, the City Council held a public hearing on September 5, 2006, at which time <br />the appellants and any other member of the public were offered an opportunity to present <br />evidence regarding this appeal; and <br /> <br />WHEREAS, after a review of the materials presented, the City Council determined that <br />the proposed administrative design review, as conditioned, is appropriate and is consistent with <br />the zoning regulations for the zoning district of the property. <br /> <br />NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Pleasanton <br />the following: <br /> <br />Section 1. Upholds the decision of the Zoning Administrator, thereby approving <br />Case PADR-1542, the application of Robert Sweeney Construction, for Jim Rhoades, for <br />administrative design review approval to construct an approximately 1,224-square-foot <br />second-floor addition and an approximately 120-square-foot first-floor addition to the <br />front of the existing residence located at 3227 Anastacia Court; subject to the conditions <br />shown on Exhibit 8, attached hereto and made a part of this case by reference. <br />
