RESOLUTION NO. 06-062 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, CALIFORNIA, UPHOLDING THE ZONING ADMINISTRATOR'S APPROVAL OF THE APPLICATION OF ROBERT SWEENEY CONSTRUCTION, FOR JIM RHOADES, FOR ADMINISTRATIVE DESIGN REVIEW APPROVAL, AS FILED UNDER CASE PADR-1542 WHEREAS, Robert Sweeney Construction, for Jim Rhoades, has applied for administrative design review approval to construct an approximately 1,224-square-foot second-floor addition and an approximately 120-square-foot first-floor addition to the front of the existing residence located at 3227 Anastacia Court; and WHEREAS, zoning for the property is R-1-7,500 (Single-Family Residential) District; and WHEREAS, within the time specified by the Pleasanton Municipal Code, Steve and Carol Stanton submitted an appeal (Case PAP-97) of the Zoning Administrator's approval; and WHEREAS, at its meeting of July 26, 2006, the Planning Commission, after having considered all public testimony, relevant exhibits, and recommendations of City staff concerning this application, denied the appeal, thereby upholding the Zoning Administrator's approval; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the appellants submitted an appeal (Case PAP-98) to the Planning Commission's decision; and WHEREAS, at its meeting of September 5, 2006, the City Council received a report from the Director of Planning and Community Development, together with a copy of the staff report to the Planning Commission, regarding this matter; and WHEREAS, the City Council held a public hearing on September 5, 2006, at which time the appellants and any other member of the public were offered an opportunity to present evidence regarding this appeal; and WHEREAS, after a review of the materials presented, the City Council determined that the proposed administrative design review, as conditioned, is appropriate and is consistent with the zoning regulations for the zoning district of the property. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Pleasanton the following: Section 1. Upholds the decision of the Zoning Administrator, thereby approving Case PADR-1542, the application of Robert Sweeney Construction, for Jim Rhoades, for administrative design review approval to construct an approximately 1,224-square-foot second-floor addition and an approximately 120-square-foot first-floor addition to the front of the existing residence located at 3227 Anastacia Court; subject to the conditions shown on Exhibit 8, attached hereto and made a part of this case by reference.
