<br />RESOLUTION NO. 06-068 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING <br />THE APPLICATION OF CHARLES AUSTIN AND SCOTT AUSTIN FOR A GENERAL PLAN <br />AMENDMENT, AS FILED UNDER CASE PGPA-ll <br /> <br />WHEREAS, at its meeting of October 17,2006, the City Council received an application <br />from Charles Austin and Scott Austin for a General Plan amendment to change the land use <br />designation of an approximately 30-acre hillside property located at 3459 Old Foothill Road from <br />Rural Density Residential (1 du/5 ac) to Low Density Residential (<2 du/ac) on approximately <br />eight acres with a maximum of eight units and to Open Space/Agriculture and Grazing on the <br />remaining 22 acres; and <br /> <br />WHEREAS, on August 23, 2006, the Planning Commission held a public hearing on the <br />proposed change and made recommendations to City Council; and <br /> <br />WHEREAS, based on the Initial Environmental Study prepared for the project, the City <br />Council adopted a Negative Declaration on October 17, 2006; and <br /> <br />WHEREAS, a duly noticed public hearing was held on October 17, 2006, with respect to <br />the General Plan amendment. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pleasanton <br />the following: <br /> <br />Section 1. The City Council approves PGPA-11, the application of Charles Austin and <br />Scott Austin for a General Plan amendment to change the land use designation of an <br />approximately 30-acre hillside property located at 3459 Old Foothill Road from Rural <br />Density Residential (1 du/5 ac) to Low Density Residential (<2 dulac) on approximately <br />eight acres with a maximum of eight units and to Open Space/ Agriculture and Grazing <br />on the remaining 22 acres, as shown on the attached Exhibit A, General Plan Map dated <br />October 17, 2006, and incorporated herein by this reference. <br /> <br />Section 2. The City Council determines that this is one of the four times in 2006 that the <br />Land Use Element of the General Plan may be amended as provided in Government <br />Code Section 65631. <br /> <br />Section 3. This resolution shall become effective immediately upon its passage and <br />adoption. <br /> <br />ADOPTED by the City Council of the City of Pleasanton this 17th day of October 2006. <br /> <br />I, Karen Diaz, City Clerk of the City of Pleasanton, California, certify that the foregoing <br />resolution was adopted by the City Council at a regular meeting held on the 17th day of October <br />2006, by the following vote: <br /> <br />Ayes: <br />Noes: <br />Absent: <br />Abstain: <br /> <br />Councilmembers Brozosky, McGovern, Sullivan, Thorne, Mayor Hosterman <br />None <br />None <br />None <br />
