CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-171 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION VACATING A PUBLIC STORM DRAIN <br />EASEMENT AT 4470 MIRADOR DRIVE <br /> <br /> at its meeting of September 1, 1992, the city Council <br /> reviewed the a staff report (SR 92:351) from the Director <br /> of Public Works and Utilities recommending the vacation <br /> of a public storm drain easement along the northerly <br /> portion of Lot 11, Block 2,. Tract 2093; and <br /> that portion of the public storm drain easement is not <br /> required and has not been used since its dedication; <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section !: <br /> <br /> Pursuant to Chapter 4 of the Streets and Highways Code <br />and based upon the findings above establishing that <br />approximately 760 square feet (10' x 76') of the public <br />storm drain easement along the northerly portion of Lot <br />11, Block 2, Tract 2093 (4470 Mirador Drive) is not <br />required for public storm drain purposes pursuant to <br />Section 8333 of the Streets and Highways Code, the public <br />storm drain easement described in Exhibit "A" is hereby <br />vacated. <br /> <br />Section 2: The City Clerk shall cause a certified copy of this <br /> resolution of vacation to be recorded in the office of <br /> the Alameda County Recorder. <br /> <br />Section 3: <br /> <br />Section 4: <br /> <br /> That from and after the date the resolution is <br />recorded, the public storm drain easement vacated no <br />longer constitutes a public storm drain easement. <br /> <br /> This resolution shall become effective immediately <br />upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON SEPTEMBER 1, 1992 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers - Butler, <br />Mayor Mercer <br />None <br />None <br />None <br /> <br />Michael H.
