CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 92-148 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO <br />SIGN VARIOUS DOCUMRNTS PERTAINING TO THE <br />CITY' S ACQUISITION OF PROPERTY WHERE THE <br />TASSAJARA RESERVOIR WI~.~. BE LOCATED AND <br />AUTHORIZING THE CITY' S ACCEPTANCE OF THE <br />PROPERTY. <br /> <br />WHEREAS, <br /> <br />the City has formed an assessment district for the <br />purpose of financing improvements to the water supply <br />system in the North Pleasanton area; and <br /> <br />WHEREAS, <br /> <br />one of the major water systems to be constructed is the <br />Tassajara Reservoir, to be located off Tassajara Road, <br />north of the City limits; and <br /> <br />WHEREAS, <br /> <br />the City Council adopted a Negative Declaration for this <br />facility in October, 1986; and <br /> <br />WHEREAS, <br /> <br />in order to house this facility on the Tassajara Road <br />property, the City, through assessment district funds, <br />needs to acquire land from the property owners, the Lin <br />Family; and <br /> <br />WHEREAS, <br /> <br />the parties have negotiated terms and conditions <br />acceptable to both parties concerning the City's <br />acquisition of certain property belonging to the Lins. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Section 2: <br /> <br /> The City Manager is authorized to sign the attached <br />documents with the Lin Family: Acquisition Agreement, <br />Grand Deed, Grant of Easement (vehicle access), Grant of <br />Easement (utility easement), License Agreement (slope <br />area), Permit for Right of Entry, and any other <br />documents, such as a Promissory Note as contemplated in <br />the Acquisition Agreement, to carry out the City's <br />acquisition of this property. <br /> <br /> Upon satisfaction of all conditions to the A6quisition <br />Agreement, the City accepts the property described in the <br />Grant Deed and Grants of Easement and authorizes <br />recording of all documents related thereto. <br /> <br />Section 3: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
