pr.a NN=NG COMM=SSION CSTY OF PLEASANTON <br />Ar.aMEDA COUNTY , CAL=FORMA <br />RESOLUTION NO_ PC-90-29 <br />RESOLUTION APPROV SNG A CONDST=ONAL USE PERMIT FOR CASE <br />UP-90-9 <br />FTHEREAS, Donald Rickard has applied for a conditional use permit <br />to build a skateboard ramp within tine backyard of an <br />existing residence located at 738 Sy lvaner Drive; and <br />WHEREAS, zoning for the property is R-1-6500 (Single-family <br />Residential) District; and <br />WHEREAS, at their duly noticed public nearing of March 28, 1990, <br />the Planning Commission considered all public testimony, <br />relevant exhibits and recommendations of the City staff <br />concerning this application; and <br />WHEREAS, the Planning Commission made the following findings o <br />1 _ That the proposed location of the conditional use <br />is in accordance with the objectives o£ the zon ir~g <br />ordinance and the purposes o£ the district in which <br />the site is located_ <br />The proposed ramp would be designed, located and <br />operated in conformance with the regulations of the <br />City's Municipal Code_ As conditioned, the noise <br />would be minimized in keeping with the purposes of <br />the R-1 Zoning District _ <br />2 _ That the proposed location of the conditional use <br />and the conditions under which it would be operated <br />or maintained will not be detr imentai to the public <br />nee itn, safety or welfare, or materially injurious <br />to the properties or improvements in trie vicinity _ <br />The proposed location, combined with the Code <br />required design and use restrictions sriould insure <br />operation o£ the ramp in a manner that would not be <br />detrimental to the public nee lth, safety, etc_ of <br />the surrounding properties _ The structure has been <br />orientated away from adj acent residences , in such a <br />way that no adjacent house is closer than 45' The <br />setback from the east side yard is 39' west side <br />yard is 2 9 ' 9 •• rear yard setback i s 2 6 ' _ Upon <br />completion, the ramp would be enclosed on the sides <br />and ends and insulated beneath the frame in such a <br />manner that noise levels would be less than 60 dBA <br />or the ramp would nave to be re eng ineer ed _ <br />
