<br />Ordinance No. 1938 <br />Page 5 of 17 <br /> <br />11. Prior to recordation of the final map, the applicant shall grant to the City an easement for <br />an emergency vehicle access (EVA) road on the Reznick property. The exact location of <br />the EVA shall be shown on the tentative map and the applicant shall be responsible for <br />construction of the EVA on his property. If the applicant provides an EVA connection <br />from the private road to the Roberts' driveway, the applicant shall secure an easement <br />from the Roberts to connect the EVA to their driveway and to allow the existing Roberts' <br />driveway to serve as an EVA to Old Vineyard Avenue. Furthermore, the applicant shall <br />construct the EVA connection to the Roberts' driveway. The exact location of the EVA <br />connection to the Roberts' driveway shall be subject to the Roberts' review and <br />approval. <br /> <br />12. This PUD development plan shall be of no further validity and the project developer shall <br />be required to submit the same or new development plan for City approval prior to <br />development of the site in the event that the project developer fails to record a final map <br />within two (2) years of this PUD Development Plan approval. <br /> <br />13. This development shall be considered as a "first-come, first-served" project for growth <br />management purposes. <br /> <br />14. The developer shall pay any and all fees to which the property may be subject prior to <br />issuance of building permits. The type and amount of the fees shall be those in effect at <br />the time the building permit is issued. <br /> <br />15. The Open Space Management and Wildland Fire Protection Plan shall be modified as <br />follows: <br /> <br />a. The open space uses shall be modified to conform to the uses listed in PUD <br />condition No. 2.b. <br /> <br />b. The entire language from PUD Condition No. 31, regarding raptor nests, shall be <br />included. <br /> <br />c. Examples of extremely flammable plantsltrees shall be provided. <br /> <br />d. More details shall be provided on the allowable pruning of existing trees for <br />purposes of fire management. <br /> <br />e. Specific details shall be provided regarding how far new trees should be planted <br />from existing tree canopies to avoid the creation of fuel ladders. <br /> <br />Said modifications shall be incorporated into a final edition of the Open Space <br />Management and Wildland Fire Protection Plan which shall be subject to the <br />review and approval by the Planning Director and Fire Marshal. <br /> <br />16. Drainage from the development shall not drain onto the adjacent Brozosky and Roberts <br />properties, 1 Brozosky Hill Lane and 1666 Frog Hill Lane, respectively. <br /> <br />17. The design and location of the retaining walls for the infiltration planters shall be included <br />with the subdivision improvement plans and shall be subject to the review and approval <br />by the Planning Director. <br /> <br />5 <br />
