<br />25. The property owners association shall be responsible for maintaining the City- <br />owned property on both sides of the Emergency Vehicle Access (EVA) to <br />Montevino Drive. <br /> <br />26. The CC&R's for the project shall prohibit the parking of boats, campers, and <br />trailers on site. <br /> <br />27. Prior to recordation of the final subdivision map, all modifications required to the <br />design guidelines thorough conditions of approval shall be combined into a single <br />comprehensive document. This document shall be submitted to the Planning <br />Director for review and approval prior to publication. The project developer or its <br />successor in interest shall disclose the design guidelines to the lot buyers prior to <br />close of escrow, and shall provide them with copies of the guidelines. <br /> <br />28. The proposed phasing of this development shall be depicted on the tentative <br />subdivision map and shall include narrative explaining the phasing. All remaining <br />pad areas shall be planted with a hydroseed mixture consisting of the following <br />species and rate-of-cover: crimson clover (20.0 lbs/acre), California poppy (3.0 <br />lbs/acre), valley lupine (5.0 lbs/acre), farewell-to-spring (2.0 lbs/acre), and African <br />daisy (2.0 lbs/acre). The hydroseed mixture shall be specified on the <br />improvement/landscape plans for review and approval by the Planning <br />Commission and shall be maintained by the project developer until sold and then <br />shall be maintained by the lot owner. <br /> <br />29. The recorded deed of sa1e for all lots covered by this PUD Development Plan <br />approval shall include the following: <br /> <br />a. A clause which states that the property is in an area subject to noise, dust, <br />and vibration levels from gravel harvesting and processing and that the City <br />of Pleasanton is not liable for possible damages due to such impacts. <br /> <br />b. The recorded deed of sale shall include a noise/dust/vibration easement. <br /> <br />c. A disclosure statement shall be provided to prospective purchasers and <br />tenants by lot owners, developers, and future successors in interest <br />providing full disclosure of the potential future mining operations within <br />the Specific Plan Area. <br /> <br />d. The recorded deed of sale for all lots shall include a disclosure statement <br />indicating the close proximity of the Vineyard A venue Corridor Specific <br />Plan area to the Livermore Municipal Airport and of possible impacts to <br />homes due to aircraft overflights. <br /> <br />10 <br />
