<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO, <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF CHARLES AUSTIN AND <br />SCOTT AUSTIN FOR PUD REZONING AND DEVELOPMENT PLAN APPROVAL, <br />AS FILED UNDER CASE PUD-58 <br /> <br />WHEREAS, Charlcs Austin and Scott Austin have applied for PUD rezoning and development <br />plan approval to rezone an approximately 30-acre hill propcrty located at 3459 Old <br />Foothill Road from A (Agriculture) District to PUD-LDR (Planned Unit <br />Devclopmcnt - Low Density Rcsidential) District on cight acres and to PUD-AG <br />(Planned Unit Development - Agriculture and Grazing) Districts on the remaining <br />22 acres, and to subdividc thc subjcct propcrty into cight custom home sites and to <br />designate the remaining 22 acres for permanent open space; and <br /> <br />WHEREAS, based on the Initial Environmcntal Study, a Ncgative Dcclaration was adopted by <br />thc City Council on October 17,2006; and <br /> <br />WHEREAS, at its meeting of Octobcr 17, 2006, thc City Council reccivcd thc Planning <br />Commission's positive recommendations for approval of the PUD rezoning and <br />developmcnt plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on Octobcr 17, 2006; and <br /> <br />WHEREAS, after a review of the materials prcsented, the City Council determined that the <br />proposed rczoning is appropriate for the site; and <br /> <br />WHEREAS, the City Council finds that thc proposed PUD rezoning and devclopment plan are <br />consistcnt with the General Plan policies ofthe City of Picas ant on and thc purposes <br />of the PUD ordinancc, <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Scction I. Approvcs the rezoning of an approximately 30-acre hill property located at <br />3459 Old Foothill Road from A (Agriculture) District to PUD-LDR (Planned Unit <br />Dcvclopment - Low Density Rcsidcntial) District on eight acres and to PUD-AG <br />(Planned Unit Dcvelopment - Agriculture and Grazing) Districts on the remaining <br />22 acres, <br />
