Commissioner Horan agreed with the app 1 i cant regarding their request f or a wrought iron fence _ However ~ he would l ike the issue s o f the f ence ~ infra structure ~ 1 ands cap ing ~ and the recreation area to go back be £ ore the Design Review Board _ He a 1 so agreed with the app 1 i cant as to condition 5 3 and f e 1t it cou 1d be e 1 iminated _ Discussion ensued a s to the £ ea s ibi 1 ity o f e 1 im inat ing condition 53_ Commi s s i oner Horan concluded that even though he would vote in favor o f the project he f e 1t trapped by the contradictions in regard to the over 1 ay d i str i ct and the supposed s acredne s s o f trees _ He compared the proposed s ite to Cast 1 ewood and fe 1t the proposed s ite area cou 1 d be aqua 1 1y attractive _ He f e 1t that peop l e would rather s ee houses tucked in between trees rather than what i s now s een on Footh i 1 1 Road _ Commissioner MCGii irk ba s i ca 1 1y agreed with Commissioner Horan however ~ he s aid he cou 1d not support the project _ He fe 1t that the Heritage trees i s sue cou 1d be worked out _ He wou 1d 1 ike Footh i 1 1 Road to stay a s it i s a s much a s pos s ib 1 e_ He thought that the 1 ots cou 1d be redistributed and h id more behind the trees _ He reiterated that he cannot support the project . Commissioner Mi the 1 ott i s aid she agrees with Commissioners Horan and McGU i rk , however ~ the other factor i s that the Commission approved the over lay d i str ict guide 1 Ines ~ but that th i s project wa s to be exempt from those guide 1 ine s becaus e o f the t ime frame _ She felt the f ence type could be worked out with staff _ S n regard to the impact fees ~ she f e 1t that other developers have to pay them s o th i s pro j act Shou 1d do l ikewi s e _ Commissioner Hovingh stated even though he wi 1 1 support the project ~ he a 1 s o fee 1 s trapped in it becaus a o£ Footh i 1 1 Road and the over lay d i str i ct _ He a 1 s o expressed concern that the road to the Yee resident i s too narrow ~ but Knows that trees wi 1 1 have to be sacr i £ i cad in order to widen it _ Further d i scu s s i on ensued regarding Footh i 1 1 Road and pos s ib1 e future widening _ Chairman Mahern stated she agrees with the other comment s in that she i s not really comfortable with the project and its i s sues _ She agreed with Staff that it i5 not the issue Of saving trees but more o£ a matter of infra structure becaus a of being h i 1 1 s ide development _ She said she does not like ~~i~appea~-a~~~a-f ~3~~ --mootYie placement o£ tYae lots along FootYaill Roads but feels She must live With it _ She would not Change conditions 4 ~ 50 ~ and 5 3 _ As far as the road i s concerned ~ i f it can be widened by 1 - 2 ft _ without taking any trees ~ she wou 1d MI MlliES PLAMNIN6 CQ~~I SSIOM I•ECE•RiER l2, 1990 Page l0
