Box 520 <br />Pleasanton, CA 94566 <br /> <br />PREANNEXATION AND PROVISION OF SEWERAGE <br />FACILITIES AND SERVICE AGREEMENT <br /> <br />THIS AGREEMENT is made this _ day of _,2006 between the City of Pleasant on, <br /> <br /> <br />a municipal corporation (City) and Charles and Delores Gragg (Owners). <br /> <br />RECITALS <br /> <br />A. Owners are the owners of certain real property located at 760 Mockingbird Lane, <br />Pleasanton, CA, more particularly described in Exhibit A (the Exhibit A property) <br />and incorporated herein by reference. <br /> <br />B. Owners wish to connect the Exhibit A property to the City sewer system in order <br />to eliminate the need to repair and reconstruct an existing septic tank and leach <br />field system. <br /> <br />C. Generally, City policy requires property to be annexed prior to extending such <br />City services as sewer service. <br /> <br />D. Owners are willing to annex the Exhibit A property either as part of a larger <br />annexation or as part of a smaller annexation involving properties and other <br />property contiguous to the City. <br /> <br />E. The public health, safety, and welfare of the City's residents are well served by <br />eliminating the need for septic tanks and by connecting to the City's sewer <br />system. <br /> <br />F. City is willing to extend its sewer service only if there are assurances that the <br />properties won't be further subdivided without approval ofthe City. <br /> <br />NOW, THEREFORE, City and Owners hereby agree as follows: <br /> <br />I. Sewer Service. Owners may connect to City's sewer system prior to the City's <br />annexation of the properties upon the satisfaction of the following conditions: <br /> <br />(a) Owners shall pay the then-existing sewer connection fees for connecting <br />to the City sewer system in accordance with applicable City ordinances <br />and master fee schedules. <br /> <br />I <br />
