CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-79 <br /> <br />RESOLUTION PERMITTING CITY OF PT~ASANTON TO <br />JOIN IN AMICUS BRIEF <br /> <br />WHEREAS, <br /> <br />there is pending in the California Court of Appeal, <br />Fourth Appellate District, Division Two, the matter of <br />Waste Manaqement v. Palm Sprinqs Rec¥clinq, in which <br />important issues concerning a city's ability to comply <br />with AB 939 and adversely impact upon its trash <br />collection franchise agreement; and <br /> <br />WHEREAS, <br /> <br />an amicus curiae (friend of the court) brief is being <br />written in which other cities may join at no cost; and <br /> <br />WHEREAS, <br /> <br />the City Attorney has recommended to the City Council <br />that the City of Pleasanton be added to the amicus curiae <br />brief, at no out-of-pocket expense to the local <br />taxpayers. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> The City Council hereby approves joinder of the City of <br />Pleasanton in the amicus curiae brief in the case of <br />Waste Management v. Palm Springs Rec¥clinq, pending in <br />the California Court of Appeal, Fourth Appellate <br />District, Division Two, such participation to be at no <br />out-of-pocket expense to the City of Pleasanton. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON APRIL 21, 1992, BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: None <br />ABSENT: Councilmember Butler <br />ABSTAIN: None <br /> <br />Councilmembers - Mohr, Scribner, Tarver, and Mayor Mercer <br /> <br />APPROVED~~AS ~TO ~ <br /> <br />Michael H.
