CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-71 <br /> <br />RESOLUTION DENYING THE APPEAL (AP-92-07) OF <br />MARSH/SMITH ASSOCIATES OF THE DECISION OF THE <br />PLANNING COMMISSION TO DENY THE APPLICATION <br />FOR A GENERAL PLAN AMENDMENT, REZONING, AND <br />DEVELOPMENT PLAN APPROVAL, AS FILED UNDER CASE <br />GP-91-3/PUD-91-3 <br /> <br />WHEREAS, <br /> <br />at its meeting of March 25, 1992, the Planning Commission <br />denied the application of Marsh/Smith Associates for 1) a <br />General Plan Amendment to change the Land Use Designation <br />from General and Limited Industrial to Medium Density <br />Residential; and 2) Planned Unit Development rezoning and <br />development plan approval for a 52-unit, single-family <br />detached residential project on an 18.6 acre site located <br />at the southeast corner of the intersection of Sunol <br />Boulevard and Interstate Highway 680; and <br /> <br />WHEREAS, <br /> <br />zoning for the property is Industrial Park (I-P) <br />District; and <br /> <br />WHEREAS, <br /> <br />within the time specified by the Pleasanton Municipal <br />Code, the applicant submitted an appeal to the city Clerk <br />of the city of Pleasanton; and <br /> <br />WHEREAS, <br /> <br />a duly noticed public hearing was held before the City <br />Council on April 7, 1992, at which time all pertinent <br />testimony and documents were reviewed; and <br /> <br />WHEREAS, <br /> <br />subsequent to the Planning Commission denial and the <br />hearing before the City Council, the applicant prepared <br />a new development plan for a 37-unit development on the <br />same site; and <br /> <br />WHEREAS, <br /> <br />after a review of the material presented, the City <br />Council finds that plan has significant changes that must <br />be reviewed by the Planning Commission before a decision <br />can be made by Council; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Denies without prejudice Case AP-92-7, the application <br />of Marsh/Smith Associates for 1) a General Plan Amendment <br />to change the Land Use Designation from General and <br />Limited Industrial to Medium Density Residential; and <br />2) Planned Unit Development rezoning and development plan <br />approval for a 52-unit, single-family detached <br />residential project on an 18.6 acre site located at the <br />southeast corner of the intersection of Sunol Boulevard <br />and Interstate Highway 680. <br /> <br /> <br />
