CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 92-67 <br /> <br />RESOLUTION VACATING PORTIONS OF PUBLIC SERVICE <br />EASENRNT ADJACENT TO HACIENDA COMMONS <br />APARTMENTS ALONG OWENS DRIVE <br /> <br />WHEREAS, <br /> <br />at its meeting of April 7, 1992, the City Council <br />received a staff report (SR 92:150) recommending the <br />vacation of portions of a public service easement <br />adjacent to Hacienda Commons Apartments, more <br />particularly shown on Exhibit "A", attached hereto and <br />incorporated herein by this reference; and <br /> <br />WHEREAS, <br /> <br />those portions of the public service easement are not <br />required and have not been used since dedication; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Pursuant to Chapter 4 of the Streets and Highways Code <br />and based upon the findings above establishing that <br />approximately 1,059 square feet of the public service <br />easement along Owens Drive are not required for public <br />utility purposes pursuant to Section 8333 of the Streets <br />and Highways Code, the public service easements described <br />in Exhibit "A" are hereby vacated. <br /> <br />Section 2: <br /> <br /> The City Clerk shall cause a certified copy of this <br />resolution of vacation to be recorded in the Office of <br />the Alameda County Recorder. <br /> <br />Section 3: <br /> <br /> That from and after the date the resolution is <br />recorded, the public service easement vacated no longer <br />constitutes a public service easement. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON APRIL 7, 1992 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers <br /> Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />- Butler, M0hr, Scribner, Tarver, and <br /> <br />APPROVED AS <br /> <br />Michael H.
