CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 92-67 RESOLUTION VACATING PORTIONS OF PUBLIC SERVICE EASENRNT ADJACENT TO HACIENDA COMMONS APARTMENTS ALONG OWENS DRIVE WHEREAS, at its meeting of April 7, 1992, the City Council received a staff report (SR 92:150) recommending the vacation of portions of a public service easement adjacent to Hacienda Commons Apartments, more particularly shown on Exhibit "A", attached hereto and incorporated herein by this reference; and WHEREAS, those portions of the public service easement are not required and have not been used since dedication; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: Pursuant to Chapter 4 of the Streets and Highways Code and based upon the findings above establishing that approximately 1,059 square feet of the public service easement along Owens Drive are not required for public utility purposes pursuant to Section 8333 of the Streets and Highways Code, the public service easements described in Exhibit "A" are hereby vacated. Section 2: The City Clerk shall cause a certified copy of this resolution of vacation to be recorded in the Office of the Alameda County Recorder. Section 3: That from and after the date the resolution is recorded, the public service easement vacated no longer constitutes a public service easement. Section 4: This resolution shall become effective immediately upon its passage and adoption. I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT A MEETING HELD ON APRIL 7, 1992 BY THE FOLLOWING VOTE: AYES: Councilmembers Mayor Mercer NOES: None ABSENT: None ABSTAIN: None - Butler, M0hr, Scribner, Tarver, and APPROVED AS Michael H.
