Resolution No. PC-2006-09 <br />Page Two <br />2_ The proposed location of the conditional use and the conditions under <br />which it would be operated or iTiaintained will not be detrixricntal to the <br />public health, safety, or welfare, or n~atcri ally injurious to the properties or <br />iniproven-tents in the vicinity. <br />'1'hc proposed school would have direct access to and from the parking lot. Thus, <br />its operation should not interfere with other businesses in the same shopping <br />center. in addition, classes would be held inside the tenant space in enclosed <br />rooms. The noise from lectures and classroom discussions would not be audi blc <br />from the adjacent tenant space; thus, it would not impact the adjacent business's <br />ability to operatc_ <br />The data collected from the parking lot observations indicated that the shopping <br />center has adequate parking to accommodate the parking demand from the <br />proposed school in conjunction with the existing businesses. While parking may <br />not be available in the areas immediately adj accent to the proposed school, other <br />areas throughout the parking lot provide the needed parking, and these areas are <br />easily accessible from the shopping center. Thus, this finding can be made. <br />3. The proposed conditional use will con-tply with each of the applicable <br />provisions of the "Coning Ordinance. <br />Based on the proposal and the artalysis on laud use, noise, and parking, granting a. <br />conditional use permit to the proposed use would be consistent with the City's <br />ability to regulate related coning rcgulations_ Therefore, this finding can be n~ade_ <br />WHERL?AS, the Planning Commission determined that the proposed conditional use would be <br />compatible with the existing uses in the area_ <br />NOW, THEREFORE., '['HE PLANNING COMMISSION OF "1'HE C[TY OF PLNASANTON <br />RESOLVES THE FOLLO WiN C:: <br />Section 1 _ Approves Case PCi_7P-153, the application of Jason Skinner/resigns School of~ <br />Cosxn etology for a conditional use permit to allow a trade school in zu~ existing <br />tenant suite located at 5572 Springdale Avenue, subj cet to the conditions shown <br />in Exhibit B, attached hereto and n-tade part of this case by refereuec_ <br />Section 2. This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
