EXHIBIT B <br />CONDITIONS OF APPROVAL <br />PCUP-149, RG'lub Interactive Fitness, Inc_ <br />11533 Dublin Canyon Road <br />January 25, 2006 <br />1. "1'he proposed use covered by this approval shall be in substantial conformance to the plans <br />and narrative, shown as Exhibit A, dated "Received November 23, 2005," on -File with the <br />Planning Departrneni, except as modified by the following conditions. Minor alterations may <br />be approved by the Planning Director if found to be in substantial conformance with Lhis <br />approval . <br />2. Approval of this application shall be contingent upon approval of the PUD Minor <br />Modification application (Case No. PL7D-81-02-02M~_ <br />3. In the event that the applicant proposes to modify the hours of operation or other aspects of <br />the business operation including, but are not li~nitcd toy tenant space expansion, or to modify <br />the exterior building or site, the modification shall be subject to the review of the Planning <br />Director- The Planning Director nay approve the ~nodilication or refer the matter to the <br />Planning Commission ifjudged to be substantial. <br />4. A iralTic study is required at the time when either an expansion of the existing facility or a <br />new facility results in occupying more than 5,000 square feet of the building area.. Prior to <br />the expansion or the operation of a new fitness facility, a traffic study shall be reviewed and <br />approved by the. Planning Director and the City Traffic I--:n gineer_ <br />5. If operations of this use permit results in conIIicts pertaining to parking, interior noise, <br />traffic/circulation, or other factors, at the discretion of the Planning Director, this conditional <br />use permit niay be submitted to the Planning Coiriiriission t~>r its subsequent review at a <br />public hearing. Lt~ncecssary, the Planning Commission may iriodi£y or add conditions of <br />approval to mitigate such impacts or may revoke the said conditional use permit approval- <br />6. The facility management shall exercise its discretion in scheduling walk-in. appointments and <br />other functions/events, such as birthday parties, so that the existing on-site parking is <br />adequate for both tenants in the same building. <br />7. The applicant shall obtain a building permit prior to conimencemcnt of any work, if req aired, <br />and shall comply with all local codes, ordinances, and/or regulations including Building and <br />Fire code requirements. <br />8.
