STATEMENT OF SETT~.~ <br />AND <br /> GENERAL REL~.~.S E <br /> <br /> This Agreement and General Release is made this <br /> <br /> day of , 1992, by and <br /> <br />between CKERYL TAKENS (hereinafter "Takens") and the CITY OF <br />PTmASANTON (hereafter "City"). <br /> <br /> WHEREAS, there is now pending before the Workers <br />Compensation Appeals Board the matter of Cheryl Takens v. City of <br />Pleasanton, et al., WCAB No. 183445, in which Takens seeks <br />workers compensation benefits from City arising out of certain <br />injuries she received while employed by city; and <br /> <br /> WHEREAS, there is also a grievance pending against the City, <br />filed by Takens and the Pleasanton City Employees Association <br />(PCEA), pursuant to the then existing Memorandum of Understanding <br />between the City and the PCEA, concerning the City's decision to <br />terminate Takens' employment with the City; and <br /> <br /> WHEREAS, there is also pending in the Superior Court of the <br />State of California, Alameda County, the matter of Cheryl Takens <br />v. City of Pleasanton, Case No. V-003564-0, which action seeks <br />damages and other relief against the City for employment <br />discrimination; and <br /> <br /> WHEREAS, City denies any wrongful conduct toward Takens and <br />maintains that its employees did not unlawfully terminate nor <br />discriminate against Takens; and <br /> <br />- 1 - <br /> <br /> <br />
