CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-140 <br />RESOLUTION AUTHORIZING CITY ATTORNEY TO TAKE <br />ACTION TO DEFEND THE CITY IN CITY OF HAYWARD <br />V. AJAMEDA COUNTY LOCAL AGENCY FORMATION <br />COMMISSION <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: The Petition for Writ of Mandate in the Alameda <br />County Superior Court, Case No. H-155613-5, in the matter <br />of City of Hayward v. Alameda County Local Aaencv <br />Formation Commission, served on the real party in <br />interest, City of Pleasanton, on July 12, 1991, is hereby <br />referred to the City Attorney for action as deemed <br />necessary and appropriate to defend the City of <br />Pleasanton, its officers, agents, and employees in said <br />action, and the City Attorney is hereby authorized to <br />incur expenses reasonably necessary for such purpose. <br />Section 2: This resolution shall become effective immediately <br />upon its passage and adoption. <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON AUGUST 20, 1991 BY THE FOLLOWING VOTE: <br />AYES: Councilmembers - Butler, Mohr, Scribner, and Mayor Mercer <br />NOES: Councilmember Tarver <br />ABSENT: None <br />ABSTAIN: None <br />APP OVED AS TO FORM: <br />Michael H.
