"ATTACHMENT A" CONDITIONS OF APPROVAL Z-91-134 August 20, 1991 1. That the regrading and landscaping of Lot 6 (Tract 5835) shall conform substantially to the site plan, landscape plan, and related materials, Exhibit A (dated "Received July 15, 1991" and "Received August 6, 1991"), on file with the Planning Department. 2. That all applicable building and other City permits shall be obtained for the pool and for all retaining walls which are to be installed as part of the regrading of the subject lot. 3. That if the applicant seeks to construct any above-ground structures in the rear yard area, a plan depicting the location and appearance of all such structures shall be submitted to the Planning Department prior to construction. The Planning Department shall notify adjacent property owners by mail of the proposed structure(s) prior to taking any action. In the event that an adjacent property owner asks for a formal hearing concerning the proposed structure(s), a hearing shall be scheduled at the next available City Council meeting for Council review and approval. In the event that no hearing is requested within 7 days following the mailing of notices to adjacent property owners, the Zoning Administrator may approve, approve conditionally, or deny the application following the procedures established in Section 18.20 of the Municipal Code for Design Review Board approval of new applications. 4. That the applicant shall submit a final landscape plan for the rear yard area for review and approval by the Planning Director prior to issuance of the building permit for the swimming pool. The plan shall show the species and size of the five "screening trees" to be planted along the western property line, but may be limited to generalized information (general plant types and sizes) for the rest of the yard. The five screening trees shall be installed within six months of the pool completion and shall be maintained by the property owner in perpetuity. In the event that any of the screening trees die, the property owner shall remove and replace them with a comparable species and number of trees (subject to review and approval by the Planning Director) within 30 days. 5. That the applicant shall properly maintain the concrete "V" ditch adjacent to the rear property line at all times, making it continuously available to pass storm drainage at the full capacity to which it was designed.
