"ATTACHMENT A" <br />CONDITIONS OF APPROVAL <br />Z-91-134 <br />August 20, 1991 <br />1. That the regrading and landscaping of Lot 6 (Tract 5835) shall <br />conform substantially to the site plan, landscape plan, and <br />related materials, Exhibit A (dated "Received July 15, 1991" <br />and "Received August 6, 1991"), on file with the Planning <br />Department. <br />2. That all applicable building and other City permits shall be <br />obtained for the pool and for all retaining walls which are to <br />be installed as part of the regrading of the subject lot. <br />3. That if the applicant seeks to construct any above-ground <br />structures in the rear yard area, a plan depicting the <br />location and appearance of all such structures shall be <br />submitted to the Planning Department prior to construction. <br />The Planning Department shall notify adjacent property owners <br />by mail of the proposed structure(s) prior to taking any <br />action. In the event that an adjacent property owner asks for <br />a formal hearing concerning the proposed structure(s), a <br />hearing shall be scheduled at the next available City Council <br />meeting for Council review and approval. In the event that no <br />hearing is requested within 7 days following the mailing of <br />notices to adjacent property owners, the Zoning Administrator <br />may approve, approve conditionally, or deny the application <br />following the procedures established in Section 18.20 of the <br />Municipal Code for Design Review Board approval of new <br />applications. <br />4. That the applicant shall submit a final landscape plan for the <br />rear yard area for review and approval by the Planning <br />Director prior to issuance of the building permit for the <br />swimming pool. The plan shall show the species and size of <br />the five "screening trees" to be planted along the western <br />property line, but may be limited to generalized information <br />(general plant types and sizes) for the rest of the yard. The <br />five screening trees shall be installed within six months of <br />the pool completion and shall be maintained by the property <br />owner in perpetuity. In the event that any of the screening <br />trees die, the property owner shall remove and replace them <br />with a comparable species and number of trees (subject to <br />review and approval by the Planning Director) within 30 days. <br />5. That the applicant shall properly maintain the concrete "V" <br />ditch adjacent to the rear property line at all times, making <br />it continuously available to pass storm drainage at the full <br />capacity to which it was designed. <br />
