CITY COUNCIL OF THE CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA
RESOLUTION NO. 91-124
RESOLUTION APPROVING THE APPEAL OF MICHAEL
PEEL AND DARTlFNF CRANE (AP-91-3) THEREBY
GRANTING A VARIANCE AS FILED UNDER CASE
V-91-09
WHEREAS, at its meeting of June 26, 1991, the Board of Adjustment
denied the application of Michael Peel and Darlene Crane
for a variance from the Municipal Code to allow the
construction of a new home that would encroach within the
front and side yard setbacks, to be located at 952 Gray
Fox Circle; and
WHEREAS, zoning for the property is PUD (Planned Unit Development)
- Low Density Residential District; and
WHEREAS, within the time specified by the Pleasanton Municipal
Code, the applicants submitted an appeal to the City of
Pleasanton; and
WHEREAS, a public hearing was held before the City Council on
August 6, 1991, at which time all pertinent testimony and
documents were reviewed; and
WHEREAS, after a review of the material presented, the City
Council makes the following findings:
a. That because of special circumstances applicable to
the property, including size, shape, topography,
location, or surroundings, the strict application
of the provisions of this chapter deprives such
property of privileges enjoyed by other properties
~in the vicinity and under identical zoning
classification;
b. That the granting of the variance will not
constitute a grant of special privilege
inconsistent with the limitation on other
properties classified in the same zoning district;
c. That the granting of the variance will not be
detrimental to the public health, safety or
welfare, or materially injurious to properties or
improvements in the vicinity.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES
AS FOLLOWS:
