CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-124 <br />RESOLUTION APPROVING THE APPEAL OF MICHAEL <br />PEEL AND DARTlFNF CRANE (AP-91-3) THEREBY <br />GRANTING A VARIANCE AS FILED UNDER CASE <br />V-91-09 <br />WHEREAS, at its meeting of June 26, 1991, the Board of Adjustment <br />denied the application of Michael Peel and Darlene Crane <br />for a variance from the Municipal Code to allow the <br />construction of a new home that would encroach within the <br />front and side yard setbacks, to be located at 952 Gray <br />Fox Circle; and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br />- Low Density Residential District; and <br />WHEREAS, within the time specified by the Pleasanton Municipal <br />Code, the applicants submitted an appeal to the City of <br />Pleasanton; and <br />WHEREAS, a public hearing was held before the City Council on <br />August 6, 1991, at which time all pertinent testimony and <br />documents were reviewed; and <br />WHEREAS, after a review of the material presented, the City <br />Council makes the following findings: <br />a. That because of special circumstances applicable to <br />the property, including size, shape, topography, <br />location, or surroundings, the strict application <br />of the provisions of this chapter deprives such <br />property of privileges enjoyed by other properties <br />~in the vicinity and under identical zoning <br />classification; <br />b. That the granting of the variance will not <br />constitute a grant of special privilege <br />inconsistent with the limitation on other <br />properties classified in the same zoning district; <br />c. That the granting of the variance will not be <br />detrimental to the public health, safety or <br />welfare, or materially injurious to properties or <br />improvements in the vicinity. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />
