CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-103 <br />RESOLUTION APPROVING REIMBURSII~NT AGREIIKENT <br />FOR OVERSIZING KOTTINGER RANCH WATER TANK <br />WHEREAS, one of the conditions of the Kottinger Ranch II project <br />required the developer to construct a 500,000 gallon <br />water tank in order to service the development; and <br />WHEREAS, because additional capacity will be needed to serve other <br />developments in the area, staff requested the developer <br />to construct a 750,000 gallon tank and the City would <br />reimburse the developer for this oversizing; and <br />WHEREAS, Westbrook Housing Group is requesting payment for its <br />oversizing costs to date; and <br />WHEREAS, the attached agreement will permit the City to track <br />future developments so that the City will be reimbursed <br />as development occurs. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section 1: Approves the Reimbursement Agreement between the City <br />of Pleasanton and Westbrook Housing Group, a copy of <br />which is attached hereto and incorporated herein by this <br />reference. <br />Section 2: Authorizes the Mayor to execute the above-captioned <br />agreement, thereby reimbursing to Westbrook Housing a <br />total of $112,684.66, with $88,892.22 to be paid at this <br />time. <br />Section 3:. Authorizes temporarily advancing funds from the Water <br />Operations and Maintenance Fund to pay this reimbursement <br />in the event that there are inadequate funds in the Water <br />Expansion Fund. <br />Section 4: This resolution shall become effective immediately <br />upon its passage and adoption. <br />
