CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 91-87 <br />RESOLUTION PERMITTING CITY OF PLEASANTON TO <br />JOIN IN AMICUS BRIEF <br />WHEREAS, there is pending in the First District Court of Appeal of <br />the Stte of California, the matter of Giardina v. City of <br />Berkeley, in which important issues concerning municipal <br />elections will be decided; and <br />WHEREAS, the City Attorney's office of San Francisco has written <br />the amici curiae (friends of the court) brief in which <br />other cities may join at no cost; and <br />WHEREAS, the City Attorney and City Clerk have recommended to the <br />City Council that the City of Pleasanton be added to the <br />amici curiae brief, at no out-of-pocket expense to the <br />local taxpayers. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br />Section l: The City Council hereby approves joinder of the City <br />of Pleasanton in the amici curiae brief in the case of <br />Giardina v. City of Berkeley, pending in the First <br />District Court of Appeal of the Stte of California, such <br />participation to be at no out-of-pocket expense to the <br />City of Pleasanton. <br />Section 2: This resolution shall become effective immediately <br />upon its passage and adoption. <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON JUNE 4, 1991 BY THE FOLLOWING VOTE: <br />AYES: Councilmembers - Butler, Mohr, Scribner, Tarver, and <br />Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />APPROVED AS TO FO <br />Michael H.
