<br />Resolution No. 91-78 <br /> <br />development of a logical contiguous site such as <br />the Bonde parcel within the City's developed area <br />is preferable to sites which are further out on <br />the fringe areas of the City and further from <br />adequate roads and utilities. <br /> <br />Finally, the payment of the cancellation fee <br />(12.5% of the fair market value) will generate <br />government revenues from the Bonde property well <br />in excess of property taxes which would have been <br />received from the property. A portion of the <br />cancellation fees is directed to the Farmlands <br />Mapping Account of the state General Fund and <br />another portion of the cancellation fee is <br />directed to the state soil conservation program. <br /> <br />B. That there is no proximate noncontracted land <br />which is both available and suitable for the <br />use to which it is proposed the contracted <br />land be put, or, that development of the <br />contracted land would provide more contiguous <br />patterns of urban development than <br />development of proximate noncontracted land. <br /> <br />This is the same finding as the earlier finding <br />under paragraph 13 above. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />section 1. Council approves tentative cancellation of Williamson <br />Act Agricultural Preserve Contract 1974-3 under the <br />provisions of California Government Code section 51282 <br />removing 104 acres of land located along the northerly <br />and southerly sides of Bernal Avenue, approximately <br />2,250 feet southeasterly of Sunol Boulevard, subject to <br />the following conditions: <br /> <br />A. That the tentative cancellation of the <br />Agricultural Preserve Contract on the subject <br />property does not constitute any type of <br />development plan approval by the City and that any <br />development of the property shall be subject to <br />the standard development review procedures of the <br />City. <br /> <br />B. That the City Clerk be directed and authorized to <br />record a certificate of Tentative Cancellation for <br />the property. <br /> <br />7 <br />
