No. 4-1349-C <br /> <br />federally-funded Highway Projects specified in Volume I Section <br />II of STATE's current Local Programs Manual. <br />(3) To advertise, award and administer the con- <br />struction contract for PROJECT in accordance with the require- <br />ments of Local Agency Public Construction Act and the California <br />Labor Code, including its prevailing wage provisions. Workers <br />employed in the performance of work contracted for by CITY and/or <br />performed under encroachment permit are covered by provisions of <br />the Labor Code in the same manner as are workers employed by <br />STATE's contractors. CITY shall obtain applicable wage rates <br />from the State Department of Industrial Relations and shall ad- <br />here to the applicable provisions of the State Labor Code. Vio- <br />lations shall be reported to the State Department of Industrial <br />Relations. <br /> <br />(4) To identify and locate all high and low risk <br /> <br /> <br />underground facilities within PROJECT area and protect or other- <br /> <br />wise provide for such facilities, all in accordance with STATE's <br /> <br />"Manual on High and Low Risk Underground Facilities within Rights <br /> <br />of Way". <br /> <br />(5) If any existing public and/or private utilities <br /> <br />conflict with the construction of PROJECT, CITY will make all <br /> <br />necessary arrangements with the owners of such utilities for <br /> <br /> <br />their protection, relocation, or removal which STATE and/or CITY <br /> <br /> <br />must legally pay, CITY will bear the cost of said <br /> <br /> <br />protection,relocation, or removal, plus cost of engineering over- <br /> <br />head and inspection.
