CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 91-52 <br /> <br /> RESOLUTION APPROVING MODIFICATION OF <br /> CONDITIONS "C" AND "D" OF RESOLUTION NO. 90- <br /> 110 GRANTING TENTATIVE CANCELT~TION OF <br /> AGRICULTURAL PRESERVE CONTRACT 1975-7 (GARMS <br /> <br /> WHEREAS, A-M Homes has applied to extend the one-year time frame <br /> to two years to secure final subdivision map approval for <br /> the Garms Ranch development; and <br /> <br /> WHEREAS, zoning for the. property is Planned Unit Development (PUD) <br /> - Low Density Residential/Open Space District; and <br /> <br /> WHEREAS, on June 19, 1990, the City Council adopted Resolution No. <br /> 90-110 setting forth findings and granting tentative <br /> cancellation of Agricultural Preserve Contract 1975-7 <br /> (Garms Ranch); and <br /> <br /> WHEREAS, a public hearing was held before the City Council on <br /> April 2, 1991 at which time all pertinent testimony and <br /> documents were reviewed; and <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br /> AS FOLLOWS: <br /> <br /> Section 1: Approves modification of Resolution No. 90-110, <br /> Conditions "C" and "D" to extend the one year time frame <br /> to two years to secure final subdivision map approval for <br /> the Garms Ranch development, subject to the payment of <br /> cancellation-related fees prior to the expiration of the <br /> original one-year time frame. <br /> <br /> Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING .HELD ON APRIL 2, 1991 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Butler, Mohr, Scribner, and Mayor Mercer <br />NOES: Councilmember Tarver <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Pegg~ ~/.OEfldro~ City Clerk <br /> <br />Michael H.
