<br />ATTACHMENT 5 <br /> <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, ALAMEDA <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF BARBARA YOUNG <br />FOR PUD REZONING AND DEVELOPMENT PLAN APPROVAL, AS FILED <br />UNDER CASE PUD-44 <br /> <br />WHEREAS, Barbara Young has applied for PUD rezoning of an existing 2.9 I-acre parcel from <br />A (Agriculture) to PUD-LDR (Planned Unit Development - Low Density <br />Residential) District and for development plan approval for a three-lot residential <br />development at 11249 Dublin Canyon Road; and <br /> <br />WHEREAS, bascd on the Initial Environmental Study, a Negative Declaration was adopted by <br />the City Council on August 15, 2006; and <br /> <br />WHEREAS, at its meeting of August 15, 2006, the City Council received the Planning <br />Commission's positive recommendations for approval of the PUD rezoning and <br />development plan; and <br /> <br />WHEREAS, a duly n9ticed public hearing was held on August 15,2006; and <br /> <br />WHEREAS, after a review of the materials presented, the City Council determined that the <br />proposed rezoning is appropriate for the site; and <br /> <br />WHEREAS, the City Council finds that the PUD development plan is consistent with the <br />General Plan and the purposes of the PUD ordinance. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section I. Approves the rezoning of an existing 2.91-acre parcel located at 11249 Dublin <br />Canyon Road from A (Agriculture) to PUD-LDR (Planned Unit Development- <br />Low Density Residential) District. <br /> <br />Section 2. The Zoning Map of the City of Pleasant on, dated April 18, 1960, on file with the <br />City Clerk, designating and dividing the City into zoning districts, is hereby <br />amended by Zoning Unit Map No. 465, attached hereto as Exhibit A, dated <br />August 15,2006, and incorporated herein by this reference. <br />
