<br />30. Prior to construction, temporary six-foot tall chain link fencing or other fence type <br />acceptable to the Planning Director shall be installed around the existing trees to <br />be saved. The final location of said fencing shall be subject to the review and <br />approval of the Planning Director. Fencing shall remain in place until final <br />inspection by the Planning Department; removal of said fencing prior to that time <br />may result in a "stop work" order. In addition, the following tree preservation <br />methods shall be followed for the existing trees to be preserved: <br /> <br />a. The applicant shall utilize his best efforts to locate any new utility trenches <br />outside the drip line of the existing trees to be saved. If this is not feasible, then the <br />applicant shall submit a report from a certified arborist acceptable to the City that <br />indicates the trenching will not be detrimental to the health of the trees. <br /> <br />b. No oil, gasoline, chemicals, or other harmful materials shall be deposited or <br />disposed within the dripline of the trees or in drainage channels, swales, or areas <br />that may lead to the dripline. <br /> <br />c. No signs, wires, or ropes shall be attached to the trees. <br /> <br />d. No stockpiling/storage of construction materials, fill, etc., shall take place <br />underneath or within 5' of the dripline of the existing trees. <br /> <br />e. No equipment or temporary structures shall be placed within or beneath the <br />dripline of the existing trees. <br /> <br />Failure to comply with these requirements may result in a "stop-work" order. <br /> <br />31. If grading or tree removal is to occur during the raptor-nesting season (February I <br />to August 31), a focused survey for raptor nests shall be conducted by a qualified <br />biologist during the nesting season. The survey shall be conducted no less than <br />14 days and no more than 30 days prior to the beginning of grading or tree <br />removal. If nesting raptors are found during the focused survey, no grading or tree <br />removal shall occur within 500 feet of an active nest until the young have fledged <br />(as determined by a qualified biologist), or until the project applicant receives <br />written authorization from California Department ofFish and Game to proceed. If <br />the removal of nest trees is unavoidable, they shall be removed during the non- <br />breeding season. <br /> <br />32. Prior to the demolition of any existing structure located on the subject property, <br />the project developer shall have the structures examined for the presence of bats; if <br />found, the developer shall prepare an appropriate mitigation plan for review and <br />approval by the Planning Director prior to any demolition work. <br />
