<br />CONTRACT FOR <br />MISCELLANEOUS LANDSCAPE SERVICES <br /> <br />THIS CONTRACT is made and entered into this _ day of ,20_ by and <br />between Tree Sculpture Corporation, ("Contractor"); whose address is 2307 Blanding Avenue, Suite G, <br />Alameda, CA 94501, and telephone number is 510-521-2515 and the CITY OF PLEASANTON, a <br />municipal corporation ("City"). <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the City has awarded to the Contractor a contract for Miscellaneous Landscape <br />Services. <br /> <br />NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties agree as <br />follows: <br /> <br />Work to be Performed. The work will generally consist of maintenance oflandscaping, including trees, <br />shrubs, groundcovers, vines, hardscapes, turf, and irrigation systems all as delineated on the set of drawings <br />entitled Map of Sites, Miscellaneous Landscape Services, and related activities as described in this <br />specification. <br /> <br />Said work is more particularly shown in the following documents which are on file with the <br />Department of Public Works of the City and are incorporated herein by this reference: <br /> <br />A. Plans and Specifications entitled the Miscellaneous Landscape Services and <br />addenda thereto, if any. <br /> <br />B. Contract Amendments approved by the City Manager, done in accordance with <br />Standard Specifications. <br /> <br />C. The Proposal submitted to the City by the Contractor. <br /> <br />D. Request for Proposals. <br /> <br />E. General Provisions and Special Provisions. <br /> <br />2. Comoensation. The City shall pay the Contractor for work actually performed at the unit prices <br />set out in the Contractor's proposal to the City. The quantities of work stated therein are estimates <br />only; actual quantities will be measured for payment in accordance with the specifications. The <br />annual contract amount for October 1,2006- September 30, 2007 shall not exceed $365,910. <br /> <br />3. Contract Renewal. It should be noted that the City and the Contractor shall retain the right to <br />renew the signed Contract agreement for an additional one-year period up to, but not exceeding, <br />four additional years. This Contract may be renewed only by mutual agreement between the <br />parties involved. Each party retains the right to not renew the agreement at the time of its annual <br />review. If the parties agree that the terms shall continue and provided the base amount is <br />increased annually, beginning on October I, 2007, by the July Construction Cost Index for <br />Northern California region, the only item that shall be subject to negotiation is the following: <br /> <br />I. additional items of work: and <br />2. new plantings and associated maintenance. <br /> <br />4. Method ofPavrnent. Progress Payments - As of the twentieth day of each month, Contractor may <br />submit for review a request for progress payment, listing the amount and value of work actually <br />
