CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 91-18 <br /> <br /> RESOLUTION AUTHORIZING SETTT.RMENT OF JOAN AND <br /> EUGENE THONAK V. CITY OF PT~ASANTON <br /> <br />WHEREAS, there is now pending in the Superior Court of Alameda <br /> County the matter of Joan and Eugene Thonak v. City of <br /> Pleasanton, et al., Case No. H-120535-8, which action <br /> seeks damages for personal injuries stemming from Mrs. <br /> Thonak's riding a bicycle into a metal pole on City owned <br /> property; and <br /> <br />WHEREAS, on January 22, 1991, the City Council met in closed <br /> session to discuss terms and conditions of settlement of <br /> this action, as set forth in a confidential memorandum <br /> from the City Attorney; and <br /> <br />WHEREAS, the plaintiffs have agreed to dismiss their action with <br /> prejudice and to release the City from all claims for <br /> damages in exchange for a sum certain; and <br /> <br />WHEREAS, the parties have requested the Superior Court to make the <br /> terms of the settlement confidential, which the Courthas <br /> agreed to do. <br /> <br />NOW, THEREFORE, THECITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council authorizes settlement of the above- <br /> entitled matter as set forth in the confidential <br /> memorandum dated January 17, 1991 from the City Attorney <br /> to the City Council. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON FEBRUARY 5, 1991 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Butler, Mohr, Scribner, Tarver, and <br /> Mayor Mercer <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />APPROVED AS TO~ <br />Michael H. Roush, City Attorney <br /> <br /> <br />
