<br />Ordinance No. 1937 <br />Page 4 of6 <br /> <br />WHEREAS, news reports and other public information from as recently as 2006 related to negative <br />secondary effects of dispensaries includes: <br /> <br />. Marijuana being grown in warehouse in Livermore resulted in the arrest of more <br />than 30 people and confiscation of abut 1,400 marijuana plants. Defendants <br />claimed marijuana for medical use. (Jan. 2006 Contra Costa Times) <br /> <br />. Federal Drug agents confiscated from dispensaries in Emeryville and Oakland <br />marijuana which was packaged into candy-like names such as Trippy, Stoney <br />Rancher, Toka-Cola, Pot Tart and Budtella, which agents were concerned will <br />appeal to children. (March 2006 San Francisco Chronicle) <br /> <br />. Seven persons were arrested in Berkeley, Oakland, Castro Valley and Brentwood <br />related to four indoor marijuana growing facilities with 5,800 plants. While <br />persons arrested claimed marijuana was for medical purposes, the DEA asserts <br />that arrestees are armed fugitives responsible for other drug-related murders. <br />(April 2006 U. S. The City of Dublin summarized violent and non-violent crimes in Alameda <br />County and the San Francisco Bay Area related to medical marijuana dispensaries <br />in a report to the Dublin City Council on May 2, 2006 <br /> <br />. The City of El Cerrito compiled information about crime related to medical <br />marijuana, including "an 'invasion-style' armed robbery in November 2003 at a <br />medical marijuana club in Oakland's so-called Oaksterdam District. Four men <br />took several ounces of marijuana and cash but no one was injured. In Berkeley, <br />dispensaries have been robbed several times since 2000. In Santa Rosa, there was <br />a homicide during a residential robbery where the suspects sought medical <br />marijuana cultivated for a dispensary." (June 2006 San <br />Francisco Chronicle) <br /> <br />WHEREAS, based upon these negative secondary effects, including the crimes which pose an <br />immediate danger to the public health, safety and welfare of the community, the City <br />Council considered the staff report and attachments (SR 06: 185) at a public hearing on <br />July 18, 2006, and extended the moratorium on medical marijuana dispensaries for an <br />additional twelve months; and <br />
