<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. 1937 <br /> <br />AN URGENCY ORDINANCE EXTENDING FOR TWELVE MONTHS THE <br />MORATORIUM ON MEDICAL MARUUANA DISPENSARIES <br /> <br />WHEREAS, California voters adopted the Compassionate Use Act of 1996, which allows qualified <br />patients to use and cultivate marijuana for medical purposes without violating State law; <br />and <br /> <br />WHEREAS, the California legislature subsequently enacted the Medical Marijuana Program in 2003 <br />to establish an identification card program, as well as set parameters for cultivation and <br />possession of medical marijuana; and <br /> <br />WHEREAS, based on health, safety and welfare concerns, particularly the secondary effects involving <br />crime, the City Council adopted a moratorium on medical marijuana dispensaries at a <br />public hearing on August 15,2005; and <br /> <br />WHEREAS, the City Council subsequently extended the moratorium at a public hearing on September <br />20,2005; and <br /> <br />WHEREAS, the moratorium does not prohibit qualified patients from using (in private), or prevent <br />caregivers from assisting qualified patients in possessing, cultivating, or transporting <br />marijuana for medical purposes under State law; and <br /> <br />WHEREAS, qualified patients and their caregivers may obtain medical marijuana from dispensaries <br />throughout the San Francisco Bay Area, including, but not limited to: <br /> <br />Berkelev <br />Berkeley Cannabis Coop (Shattuck Ave.) <br />Berkeley Patients' Group (2747 San Pablo Ave.) <br />Berkeley Patients' Care Collective (2590 Telegraph Ave.) <br /> <br />Contra Costa Co. <br />ME Delivery <br />Maricare - 2155 Colfax St., Concord (also deliveries) <br /> <br />Livermore - Tri Vallev <br />Tri-Valley Delivery, Livermore/fracy <br />
