<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. 1935 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF LAURENCE <br />AND FRANCOIS CALLAIT FOR PLANNED UNIT DEVELOPMENT <br />MAJOR MODIFICATION, AS FILED UNDER CASE PUD-77-08-1M <br /> <br />WHEREAS, Laurence and Francois Callait have applied for a major modification to an <br />approved PUD development plan (PUD-77-08) to reduce the side yard <br />setback from the approved eight feet to five feet to allow the construction of <br />single-story additions totaling 637 square feet to the existing two-story <br />residence located at 5745 Northway Road in the Northway Downs <br />development; and <br /> <br />WHEREAS, zoning for the property is PUD-HDR (Planned Unit Development - High <br />Density Residential) District; and <br /> <br />WHEREAS, the project is categorically exempt from Section 15301(a) of the California <br />Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, at its meeting of May 10, 2006, the Planning Commission recommended <br />approval of the modification to the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on June 6, 2006; and <br /> <br />WHEREAS, the City Council finds that the PUD major modification is consistent with <br />the General Plan policies and the purposes of the PUD ordinance of the <br />City of Pleasanton; and <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section 1. Approves Case PUD-77 -08-1M, the application of Laurence and Francois <br />Callait for a major modification to an approved PUD development plan <br />(PUD-77 -08) to reduce the side yard setback from the approved eight feet <br />to five feet to allow the construction of single-story additions totaling <br />637 square feet to the existing two-story residence located at <br />
