<br />may result in noise, odors, dust, traffic or other conditions that may affect the lots <br />covered by this PUD Development Plan. <br /> <br />f. The project developer shall include in the project's CC&R's a disclosure regarding <br />the odor and illumination caused by the asphalt batch plant operated by Granite <br />Construction Company on the RMC Pacific Materials property located at lS44 <br />Stanley Boulevard." <br /> <br />Wording for these clauses and/or disclosures shall be submitted to the City Attorney for <br />review and approval before City Council approval of the first final subdivision map for <br />this development and shall be recorded over the project site by separate instrument. <br /> <br />27. On Lots 1 through 13, the recorded deed of sale for all these lots shall include the follow- <br />ing statement to be signed by the future homeowner stating that: <br /> <br />"You are hereby advised that this property is located near land zoned and/or <br />used for agricultural purposes. Agricultural use is defined as including but <br />not limited to day and night-time activity relating to livestock grazing, the <br />keeping of livestock, the growing and processing of agricultural crops, and <br />any commercial agricultural practices performed as incidental to or in con- <br />junction with such operations. Some of the impacts associated with agricul- <br />tural use include but are not limited to noise, odor, dust, chemicals, refuse, <br />waste, unsightliness, use of agricultural equipment, and traffic. Permitted ag- <br />ricultural pursuits conducted in accordance with good practice and mainte- <br />nance are not deemed by the City of Pleasant on to be a nuisance." <br /> <br />28. A conservation easement shall be recorded over the open space portion of Parcel "A". <br />Wording for the easement shall be submitted to the City Attorney for review and ap- <br />proval before City Council approval of the final subdivision map. <br /> <br />29. With recordation of the first final map covering this development, the project developer <br />shall pay to the City of Pleasant on fees for City distribution to the South Livermore Val- <br />ley Agricultural Land Trust. The fees shall be calculated based on a one-to-one ratio be- <br />tween the cost per acre for agricultural easements to the Land Trust and the net acreage of <br />potentially cultivable soils located on lands having less than a 2S-percent slope grade. <br /> <br />Existing Trees: <br /> <br />30. The project developer shall comply with the recommendations of the tree report prepared <br />by HortScience, Inc., dated November, 200S. The project developer shall install four, 24- <br />inch box-size specimen trees for each heritage-size tree to be removed. The locations of <br />these trees shall conform to the Conceptual Landscape Plan of Exhibit "A" and shall be <br />shown on a landscape plan submitted with the tentative subdivision map. <br /> <br />SR 06:159 <br />Page 100f21 <br />
