<br />Resolution No. 06-035 <br />Page Two <br /> <br />WHEREAS, the City has also accepted and responded to comments received during the <br />45-day public comment period regarding the Draft EIR from public <br />agencies having jurisdiction by law, persons having special expertise with <br />respect to any environmental impacts involved, and other persons and <br />organizations having an interest in the Project; and <br /> <br />WHEREAS, the Final EIR for the Project has been prepared and contains the Draft EIR , <br />comments, and recommendations received on the Draft EIR, and the <br />responses to comments raised regarding environmental issues in the review <br />and consultation process; and <br /> <br />WHEREAS, the City provided proper notice of completion of the Final EIR for the <br />Project; and <br /> <br />WHEREAS, the Planning Commission held a noticed public hearing on April 26, 2006 <br />and recommended that the City Council certify the Final EIR as adequate <br />and complete. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOL YES AS FOLLOWS: <br /> <br />Section I: Finds the Final EIR for the Project to be complete and adequate and reflects <br />the independent judgment of the City. <br /> <br />Section 2. Certifies the Final EIR for the Project, (which includes the Draft EIR), both <br />of which are on file in the Department of Planning and Community <br />Development. <br /> <br />Section 3: This resolution shall become effective immediately upon its passage and <br />adoption. <br /> <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON, AT A MEETING HELD ON MAY 16,2006 BY THE FOLLOWING <br />YOTE: <br /> <br />AYES: <br /> <br />Councilmembers - Brozosky, McGovern, Sullivan, Thome and <br />Mayor Hosterman <br />None <br />None <br /> <br />NOES: <br />ABSENT: <br />
