<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 06-032 <br /> <br />RESOLUTION AUTHORIZING SETTLEMENT OF A WORKERS' <br />COMPENSATION CLAIM <br /> <br />WHEREAS, there is now pending before the Workers' Compensation Appeals Board a case <br />concerning a retired fire captain, Gary Rose; and <br /> <br />WHEREAS, the City Attorney has requested authority from the City Council to settle this claim <br />in the amount discussed in the confidential memorandum from the City Attorney to <br />the City Council; and <br /> <br />WHEREAS, such request is reasonable and justified under the circumstances. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Attorney is authorized to settle the above-mentioned case in the amount <br />not to exceed that set forth in the City Attorney's memo to the City Council. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br />I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND REGULARLY <br />ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT A <br />MEETING HELD ON MAY 16, 2006 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers - Brozosky, McGovern, Sullivan, Thorne and Mayor Hosterman <br />None <br />None <br />None <br /> <br /> <br />APPROVED AS TO FORM: <br />{;uLUtw tHt~ <br /> <br />Michael H.
