<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, ALAMEDA <br /> <br />RESOLUTION NO. 04-056 <br /> <br />RESOLUTION ACCEPTING THE CITY CLERK'S CERTIFICATION OF <br />THE INITIATIVE TO SAVE OUR COMMUNITY PARK, DETERMINING <br />TO ADOPT THE INITIATIVE WITHOUT ALTERATION, AND <br />THEREBY AMENDING THE BERNAL PROPERTY SPECIFIC PLAN TO <br />INCORPORATE THEREIN THE INITIATIVE <br /> <br />WHEREAS, signatures on initiative petitions for the Initiative to Save Our Community Park <br />(the Initiative) were submitted to the City Clerk and delivered to the Registrar of <br />Voters for a determination whether the petitions had the requisite number of <br />verified signatures on them; and <br /> <br />WHEREAS, the Registrar of Voters verified that the Initiative qualified for the ballot and <br />delivered the petitions back to the City Clerk for certification; and <br /> <br />WHEREAS, the City Clerk placed on the City Council's July 20, 2004 agenda an item <br />requesting the City Council to accept the City Clerk's certification of the <br />Initiative; and <br /> <br />WHEREAS, under Elections Code Section 9215, the City Council has the option of adopting <br />the Initiative without alteration, in lieu of submitting the Initiative to the voters; <br />and <br /> <br />WHEREAS, on July 20, 2004, the City Council took public testimony concerning what action it <br />should take as to the Initiative; and <br /> <br />WHEREAS, based on the statements made by the authors and proponents of the Initiative, it is <br />the City Council's understanding that the phrase "the first phase of the community <br />park" (for which development is to be given the highest reasonable priority) is in <br />reference to two lighted baseball fields. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOllOWS: <br /> <br />Section 1: Accepts the certification by the City Clerk of the Initiative petitions <br />submitted on May 24, 2004, a copy of which certificate is attached <br />hereto as Exhibit 1. <br />
