<br />SITE DESCRIPTION <br /> <br />The subject site is a 4,455-square-foot lot located south of the Valley Avenue and Northway <br />Road intersection. The applicant's home is an attached, single-family residence. All existing <br />improvements on the subject site are located within the approved building setbacks. <br />A wood fence is located on the property line and around the front courtyard. There is a palm <br />tree located along the north side of the driveway, adjacent to the garage. The properties to the <br />north, south, and east are attached, single-family residences. Heatherlark Park is located across <br />the street to the south. <br /> <br />PROJECT DESCRIPTION <br /> <br />The project consists of a major modification to the approved Planned Unit Development <br />(Northway Downs, PUD-77-08) to allow construction within the required eight-foot side yard <br />building setback and design review approval for the construction of the addition and <br />modification of the garage location at 5745 Northway Road. <br /> <br />Specifically, the modification request is a result of a proposal to construct and reconstruct a total <br />of637 square feet ofthe existing residence. This would include a total of 187 square feet of <br />new habitable space, 30 square feet of additional garage space to accommodate a laundry area in <br />the garage while maintaining the code required dimensions for a two-car garage, and the <br />relocation of the existing 420 square-foot garage forward eight feet on the lot. The new garage <br />location would have a 23-foot setback from the front property line. <br /> <br />Although the City does not enforce CC&Rs. The CC&Rs for this development afford <br />homeowners the ability to process such requests and states that such requests are subject to <br />review and approval by the City of Pleasant on and the appointed Homeowners Association <br />(HOA) Committee, if such a committee exists. The HOA for this development appears to have <br />become inactive. Therefore, the City of Pleasant on processed this request based on the <br />development plan and the PUD conditions of approval without a design review & approval letter <br />from an HOA. <br /> <br />ANALYSIS <br /> <br />The Northway Downs development plan requires habitable portions of the main structure to be <br />located eight feet from the side property line, whereas the garage can be constructed within five <br />feet of the side property line. <br /> <br />SR06:l54 <br />Page 3 <br />
