PUBLIC COMMENTS <br /> <br />Noticing and Comments <br /> <br />Requests for minor PUD modifications are noticed to all property owners within a 1,000-foot <br />radius of the subject property. Ifno comments are received regarding the project, the Zoning <br />Administrator approves the request and an information report is sent to the City Council. <br /> <br />The proposed project was submitted to the City as a minor modification to the approved PUD- <br />77-08. In accordance with the application process for PUD minor modifications, staff sent <br />notices of this request on March 27, 2006. <br /> <br />On March 31, 2006, Dolores Birtcil, provided staff with a letter outlining her concerns regarding <br />the proposed project (Attachment 5). Mrs. Birtcil has owned the home located at 2330 Bay <br />Meadows Circle since 1979, but currently rents the home to others. Staff has outlined her <br />concerns as follows: <br /> <br />I. Opposition to any changes to the original home. <br />2. The proposed addition is not minor in scope. <br />3. States that the CC&Rs, do not allow for major changes of any kind to the homes. <br />4. Feels that the CC&Rs should be enforced by the City of Pleasant on. <br />5. Is concerned that the density of the development will change. <br />6. Property values would be impacted by these types of changes. <br />7. Feels that the minority should have a say in these types of matters. <br /> <br />Staffs Response <br /> <br />In response to Mrs. Birtcil's concerns regarding changes to the original homes, staff notes that <br />the PUD allows for additions to the existing homes and the City has processed four requests for <br />additions since 1997. In addition, some homes have chosen to install garden windows, a variety <br />of fencing, individual landscaping schemes, and other elements to customize their home's <br />appearance. These changes have resulted in the homes being presented as a neighborhood, <br />rather than as a development without character. <br /> <br />The processing level for PUD modification is dependent on whether the proposal is considered <br />as being supportable. If a proposal is supportable it is processed as a minor modification. If the <br />proposal is not supportable by staff or is opposed by a member of the public during the noticing <br />period, then it is processed as a major modification.
