<br />I. BACKGROUND <br /> <br />In 1977, the City Council approved the Planned Unit Development (PUD) plan for the <br />Northway Downs Development (PUD-77-08). The Northway Downs PUD requires that all <br />habitable additions to the main structure maintain a side yard setback of eight feet, where as the <br />garage is allowed to be located within five feet from the side yard property line. The applicant, <br />Laurence Callait, submitted a request for administrative design review approval to permit <br />construction of an addition to the main structure and the garage along the north side of the <br />residence (P ADR-1490). To accommodate the proposal, the applicant also submitted PUD-77- <br />08-lM, a minor modification of the PUD, to reduce the minimum side yard setback from eight <br />feet to five feet to allow the proposed addition to continue the wall line of the existing garage. <br /> <br />The City has approved additions to four homes within the development since 1997, but this is <br />the first proposal that requires a PUD modification because of the setback encroachment. <br />Absent the modification, the applicant would have to modifY their design proposal to conform to <br />the existing PUD setback requirements. <br /> <br />During the noticing period of this application staff received comments from Mrs. Birtcil and the <br />application was elevated from a PUD minor modification request to a PUD major modification <br />request. As with all PUD major modifications, this application is now subject to the review and <br />recommendation by the Planning Commission and review and final decision by the City <br />Council. <br /> <br />II. SITE DESCRIPTION <br /> <br />The subject site is a 4,455-square-foot lot located south of the Valley Avenue and Northway <br />Road intersection. The applicant's home is an attached, single-family residence. All existing <br />improvements on the subject site are located within the approved building setbacks. <br /> <br />A wood fence is located on the property line and around the front courtyard. There is a palm <br />tree located along the north side of the driveway, adjacent to the garage. The properties to the <br />north, south, and east are attached, single-family residences. Heatherlark Park is located across <br />the street to the south. <br /> <br />III. PROJECT DESCRIPTION <br /> <br />The project consists of a major modification to the approved Planned Unit Development <br />(Northway Downs, PUD-77-08) to allow construction within the required eight-foot side yard <br />building setback and design review approval for the construction of the addition and <br />modification ofthe garage location at 5745 Northway Road. <br />Case PUD-77-08-1M/PADR-1490 Planning Commission <br />Page - 2 - <br />
