<br />1. Council may resolve the tie by lot; or <br /> <br />II. Council may order a special run-off election. <br /> <br />If procedure II is selected, the Special Election must be held on a Tuesday between 40 and <br />125 days after the certification of the November election results. If a regular election is <br />scheduled to be held throughout the City during that time period, the special run-off election <br />must be consolidated with the regular election. <br /> <br />In the past, the Council has selected the special run-off election procedure and staff <br />recommends that this procedure II be adopted for the upcoming November election. <br /> <br />FISCAL IMPACT <br /> <br />The annual operating budget has already allocated $30,000 for election costs in FY <br />2005-2006, which includes the November 2006 election. With the addition of the City- <br />sponsored initiative measure to the November 2006 ballot, there may be additional costs. <br />While the allocated amount is expected to be sufficient, the Alameda County Registrar's Office <br />has not been able to advise the City with regard to projected costs for the November 2006 <br />election, as the Registrar's Office is focused on the June Primary Election and has had <br />significant staff changes. In the event of a tie vote in November and the need for a special run- <br />off election, there will be additional costs estimated as at least $75,000. <br /> <br />RECOMMENDATIONS <br /> <br />I. Adopt the attached resolution, Exhibit A, placing the Bernal Property Phase II Land <br />Use Plan Initiative on the November 7, 2006 ballot, select ballot question Option I, set June 23, <br />2006 as the deadline for direct arguments, set July 3, 2006 as the deadline for rebuttal arguments, <br />direct the City Attorney to prepare an Impartial Analysis by June 23rd, and request that the <br />County Registrar's Office consolidate the initiative measure election with the general election. <br /> <br />2. Select a sub-committee of two Council members to draft a direct argument in favor of <br />the initiative measure, which argument will be considered for signature by the entire City <br />Council on the June 20th consent calendar. <br /> <br />3. Adopt the attached resolution, Exhibit C, directing the City Clerk to consolidate the <br />municipal election with the Statewide general election, charge candidates $240 for printing <br />statements, make payment due at the time of filing nomination papers, limit statements to 200 <br />words, send only the sample ballot and voter pamphlet to voters, and hold a special election in <br />the event of a tie vote. <br /> <br />SR 06:158 <br />Page 6 of7 <br />
