<br />13. This development shall be considered as a "first-come, first-served" project for <br />growth management purposes. <br /> <br />14. The developer shall pay any and all fees to which the property may be subject <br />prior to issuance of building permits. The type and amount of the fees shall be <br />those in effect at the time the building permit is issued. <br /> <br />IS. The Open Space Management and Wildland Fire Protection Plan shall be modified <br />as follows: <br /> <br />a. The open space uses shall be modified to conform to the uses listed in PUD <br />condition No. 2.b. <br /> <br />b. The entire language from PUD Condition No. 31, regarding raptor nests, <br />shall be included. <br /> <br />c. Examples of extremely flammable plants/trees shall be provided. <br /> <br />d. More details shall be provided on the allowable pruning of existing trees for <br />purposes of fire management. <br /> <br />e. Specific details shall be provided regarding how far new trees should be <br />planted from existing tree canopies to avoid the creation of fuel ladders. <br /> <br />Said modifications shall be incorporated into a final edition of the Open Space <br />Management and Wildland Fire Protection Plan which shall be subject to the <br />review and approval by the Planning Director and Fire Marshal. <br /> <br />16. Drainage from the development shall not drain onto the adjacent Brozosky and <br />Roberts properties, 1 Brozosky Hill Lane and 1666 Frog Hill Lane, respectively. <br /> <br />17. The design and location of the retaining walls for the infiltration planters shall be <br />included with the subdivision improvement plans and shall be subject to the <br />review and approval by the Planning Director. <br /> <br />18. The applicant shall install plants for the infiltration planters. A landscape plan for <br />the infiltration planters shall be included with the subdivision improvement plans <br />and shall be subject to the review and approval by the Planning Director. The <br />applicant shall utilize plants that are appropriate for the soil and water conditions <br />in the infiltration system and that look appropriate in a grassland and/or oak <br />woodland setting. In addition, landscaping, such as vines or prostrate <br />groundcover, shall be planted along the infiltration planter retaining walls visible <br />from the Brozosky residence, as applicable, to help screen the retaining walls from <br />
