CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 99-044 <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br />WHEREAS, <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />RESOLUTION DENYING THE APPEAL (CASE AP-99-01) <br />AND THEREBY UPHOLDING THE DECISION OF THE <br />PLANNING COMMISSION TO DENY THE APPLICATION <br />OF PETER SHUTTS/RUSS MORGAN, AS FILED UNDER <br />CASE UP-98-37/Z-98-176 <br /> <br />Peter Shutts/Russ Morgan applied for design review and conditional use permit <br />approvals to allow a rental yard, outdoor storage, and accessory uses; and to allow <br />the placement and design of modular buildings, shipping containers, a maintenance <br />building, a new business sign, and the repainting of an existing building, for <br />property located at 3878 Stanley Boulevard; and <br /> <br />zoning for the property is C-S (Service Commercial) District; and <br /> <br />the Planning Commission denied the application; and <br /> <br />within the time specified by the Pleasanton Municipal Code, the applicant filed an <br />appeal of the Planning Commission's denial; and <br /> <br />a duly noticed public hearing on the appeal was held before the City Council on <br />April 6, 1999; and <br /> <br />actions of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this proposal; and <br /> <br />the City Council finds as follows: as detailed more fully in the staff reports to the <br />Planning Commission (February 10, 1999) and City Council (April 6, 1999) <br /> <br />(a) <br /> <br />the proposed modulars and shipping containers that would remain on site <br />for several years is contrary to City policy, would be unsightly, and would <br />impact negatively the development of adjacent uses; <br /> <br /> <br />
