Box 520 <br />Pleasanton, CA 94566 <br />Attn: City Clerk <br /> <br />AGREEMENT CONCERNING DEFERRED STREET IMPROVEMENTS <br />FOR 351 VIRGINIA WAY <br /> <br />This Agreement ("Agreement") is entered into this 16th day of May 2006, by and <br />between the Rick Hempy, ("Owner"), and the City of Pleasant on, a municipal <br />corporation ("City"). <br /> <br />RECITALS <br /> <br />A. Owner owns real property in the City of Pleasant on described as 351 Virginia Way, <br />Pleasanton, CA (APN 946-1706-002-10) more particularly described in Exhibit A <br />and incorporated herein by reference. <br /> <br />B. As a condition of approval for a Pre-annexation agreement, and approval for water <br />and sanitary sewer connections for the development of 351 Virginia Way, Owner <br />shall construct street frontage improvements per Chapter 19.40.010 of the Pleasanton <br />Municipal Code and to the satisfaction of the City Engineer. These improvements <br />may include, but are not necessarily limited to, grading, curb and gutter, sidewalk, <br />paving and storm drain facilities. <br /> <br />C. Although the Improvements would normally be built at the time the Owner's property <br />is developed, because the other properties in the Remen Tract are not currently <br />constructing the remaining portion ofthe public improvements, the Improvements <br />would be of little value alone. <br /> <br />D. City agrees to allow the Improvements to be installed at a later time. <br /> <br />NOW, THEREFORE, in exchange for valuable consideration, the receipt of <br />which is hereby acknowledged, the parties agree as follows: <br /> <br />I. Owner shall design and construct the Improvements as determined by the Director of <br />Planning and Community Development and the City Engineer that, in their discretion, <br />the Improvements are reasonably needed. <br /> <br />I <br />
