CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-133 <br /> <br /> RESOLUTION DENYING CITY COUNCIL APPEAL (AP-93-08) <br /> THEREBY UPHOLDING APPROVAL OF THE APPLICATION OF <br /> BARRY MORI AND ERIC NOSTRAND AS FILED UNDER CASE <br /> UP-93-47 <br /> <br />WHEREAS, the Planning Commission approved Case UP-93-47, the <br /> application of Barry Mori and Eric Nostrand for a conditional <br /> use permit to establish an approximately 3,750 square foot <br /> bar/alehouse and grill in the Hopyard Village Shopping Center <br /> located at 3015 Hopyard Road, Suites F, G, and H; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C <br /> (Commercial) District; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, <br /> the City Council of Pleasanton appealed the decision; and <br /> <br />WHEREAS, a public hearing was held before the City Council on <br /> October 12, 1993, at which time all pertinent testimony and <br /> documents were reviewed; and <br /> <br />WHEREAS, the City Council determined that the proposed conditional use <br /> is appropriate for the site. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS <br />FOLLOWS: <br /> <br />Section 1: Denies Case AP-93-08, thereby upholding the decision of <br /> the Planning Commission approving Case UP-93-47, the <br /> application of Barry Mori and Eric Nostrand for a conditional <br /> use permit to establish an approximately 3,750 square foot <br /> bar/alehouse and grill in the Hopyard Village Shopping Center <br /> located at 3015 Hopyard Road, Suites F, G, and H. <br /> <br />Section 2: This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND REGULARLY <br />ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT A MEETING HELD <br />ON OCTOBER 12 1993 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - Dennis, Mohr, Pico, Scribner, and Mayor <br /> Tarver <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> Pegg~ ~.6/E~idr~, City Clerk <br /> <br />Michael H.
