CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-118 <br /> <br /> RESOLUTION APPROVING SECOND AMENDMENT TO THE <br /> LIVERMORE AMADOR VALLEY WATER MANAGEMENT <br /> AGENCY ~OINT POWERS AGREEMEL'T <br /> <br />WHEREAS, on June 18, 1974, the cities of Livermore and Pleasanton <br /> and the Dublin San Ramon Services District ("DSRSD") <br /> executed a Joint Powers Agreement ("JPA") creating the <br /> Livermore Amador Valley Water Management Agency <br /> ("LAVWMA") for the purpose of establishing a water <br /> quality management program pursuant to Resolution 71-3 of <br /> the Regional Water Quality Control Board, San Francisco <br /> Bay Region; and <br /> <br />WHEREAS, the JPA was first modified on May 31, 1977; and <br /> <br />WHEREAS, the JPA provides that before certain Projects can be <br /> undertaken, the Project must be approved by the voters <br /> and approved unanimously by the LAVWMA Board; and <br /> <br />WHEREAS, the LAVWMA Board has been discussing its sponsorship of <br /> a Project which, if approved, would increase the sewage <br /> capacity of LAVWMA by an amount not to exceed 12.7 <br /> million gallons (Average Dry Weather Flow) per day; and <br /> <br />WHEREAS, the LAVWMABoard would like the opportunity to proceed on <br /> such a Project without the rule of unanimity which <br /> currently exists for Projects under the JPA; and <br /> <br />WHEREAS, if such an amendment to the JPA were made, the Board <br /> would intend that such Project be first submitted to the <br /> voters of Pleasanton and Livermore and that the LAVWMA <br /> Directors from those two Member Agencies would vote to <br /> participate or not participate in such a Project <br /> depending on the vote of the electorate in each Member's <br /> jurisdiction; and <br /> <br />WHEREAS, the Board would also intend that DSRSD not be required to <br /> submit the Project to the voters within DSRSD but that <br /> the LAVWMA Directors from that Member Agency would vote <br /> to participate in such a Project if a majority of the <br /> DSRSD Board so approved; and <br /> <br />WHEREAS, the Board also wishes to provide that if this Project is <br /> approved by one or more Member Agencies, that all the <br /> Member Agencies must unanimously agree prior to such <br /> Project serving any unincorporated area of Alameda County <br /> which is south of Interstate 580 or in the North <br /> Livermore Valley; and <br /> <br /> <br />
