<br />CONTRACT FOR OFFICA TING SERVICES <br /> <br />THIS AGREEMENT is made and entered into this _ day of 2006 by and <br />between the CITY OF PLEASANTON, a nmnicipal corporation ("City"), and East Bay <br />Volleyball (and other sports too) Officials Association ("Association"), whose address is <br />P.O. Box 322, San Ramon. CA 94583 (925-487-2626). <br /> <br />WITNESSETH: <br /> <br />A. Association is qualified to provide, and experienced in providing, <br />Officiating services and has offered such services for the purposes specified in this <br />Agreement. <br /> <br />B. ill the judgment of the City, it is necessary and advisable to contract the <br />services of the Association for the purposes provided herein. <br /> <br />NOW THEREFORE, in consideration of mutual covenants, agreements and <br />conditions contained herein, City and Association agree as follows: <br /> <br />1. Association's Services. Association shall provide all work described in <br />Exhibit A, Scope of Work, attached hereto and incorporated herein by reference. <br /> <br />2. IYm. Association shall begin work May 5, 2006. The work as <br />described in the Scope of Work, shall end on December 31,2007. <br /> <br />3. CO~D~n!lllltion. For the services to be rendered hereunder, City shall pay <br />Association on a tirne-and-materials basis, not to exceed $25,194 for 2006, and $27,070 <br />for 2007, based on the rate schedule set forth in Exhibit B, attached hereto and <br />incorporated herein by reference. <br /> <br />illvoices submitted, on a bi-weekly basis, to the City for payment must contain a <br />brief description of work perfonn:d, dates and number of games. Payment shalJ be <br />made within thirty (30) days of receipt of Association's invoice and upon the approval <br />of the Program Supervisor. <br /> <br />4. CbaD.l!es. City may request, from time to time, changes in the scope of <br />services to be provided by the Association. Any changes and related fees shall be <br />mutually agreed upon between the City and Association and shall be subject to a written <br />amendment to this Agreement. 'The City and Association will meet prior to and during <br />the season to agree on all issues, which may not be specifically covered in the <br />Agreement. <br /> <br />5. Association's Status. ill perfonnance of the obligations set forth in <br />this Agreement, Association shall have the status of an independent contractor and its <br />officialsshall not be considered employees of the City for any purpose. <br /> <br />1 <br />
