<br />. <br /> <br />(7) !;;~c:teTV District: <br /> <br />If the City did not want to acquire the Cemetery, but the community still wanted to create a form <br />oflocal government 10 own and operate the Cemetery, the community could form a cemetery district. <br /> <br />Cemeteries may be held publicly or privately or as cemetery districts. Cemetery districts are <br />separate local government enlities that have exclusive jurisdiction and control over the ownership, <br />operation, maintenance and management of cemeteries in their districts. 12 <br /> <br />CemetCTV District Formation: A proposal to form a cemetery district may be made by petition. <br />TIle petition must be sired by not less than 25% of the registered voters residing in the area to be <br />included in the districtl ,as detennined by the Local Agency Formation Commission (LAFCO). A <br />proposal to fonn a new district may also be made by the adoption of a resolution of application by the <br />legisla1ive body 01 the COWlty or city that contains the territory proposed to be included in the district. <br />Once the proponents have filed with LAFCO a sufficient petition or the legislative body bas filed with <br />LAFCO a resolution of application, LAFCO will approve or deny the proposal. <br /> <br />LAFCO may not approve a proposal to form a distriet unless the proposed district is in the public <br />interest and the district will have sufficient revenue to carry out its purposes. If the proposed district <br />would not have sufficic::m revenue, LAFCO may nonetheless approve a proposal if the approval is <br />conditioned on the approval by the VOletS of spec::i allaXcs or approval by the property owners of special <br />benefit assessments that will generate sufficient revenue. If the speciallaXes or special assessments arc <br />DOt approved, the proposc:d district cannot be fonned. <br /> <br />IfLAFCO approves the proposed tbrmation, it holds public heartngs 10 hear Inptn and protests <br />from votetS and property owners.. A majority protest stops the proposal, otherwise an ejection is held. <br />Only the volers inside the proposed district's bound","es may vote. A majority approval of the <br />electorate inside the proposed district's boundaries is required for the district's fonnation unless the <br />proposal involves new special taxes or special assessments. If the proposal involves new speciallaXes, <br />the measwe (which would establish the tax in addition to Conning the district) requites 2/3 voter <br />approval (213 of the VOles cast) of the registered voters residing within the proposed district boundaries. <br />If the proposal involves special benefit assessments, the measure (whicb would establish the assessment <br />in addition to fanning the district) requires 213 voter approval (2/3 of the votes cast) of the owners of <br />property within the proposed boundaries to be assessed. If tbe voters approve the proposed district, <br />LAFCO files the fonnal docwnenlS to establish the district. <br /> <br />government of Cemeterv District: A cemetery district is governed by a legislative body of at <br />least three members known as !he board of trustees. The board of trustees establishes policies for the <br />district's operation. [n the case ofa district that contains property in ooe county, after a cemetery district <br />is fanned, the board of supervisors of that county appoints three or five persons to the board oftrostecs. <br />TIle board of supervisors may appoint itse!fto be the board of trusteeS of a district or the board of <br />supervisors may divest itself of that authority. Each person appointed by a board of supervisors to be a <br />member of a board of trustees must be a voter in the districl.
