1. The Diocese would hold and maintain the permanent lot owner, burial and
financial records of the Cemetery.

2. The Diocese would have staff available off site via an "800' telephone
number and the Internet to assist customers. As necessary, staff of the
Diocese would meet with purchasers.

3. The Diocese would be the contact for funeral directors and families to
make service arrangements for interments, memorial services and
memorial installations within the Cemetery.

4. The Diocese staff would physically prepare the burial sites and the
memorial foundations and/or installations.

5. The agreement would have a term of ten (10) years with four (4), ten- (10)
year renewal options.

l
I
I
I
I
I
I
I
I
I
I

6. For its services, the Diocese would receive 50% of the retail fees for the
sale of burial rights and 100% of the service fees for interments and
memorial installations. The fees for such services would be approved by
the Foundation's Board of Directors.

This approach provides the City with these essential services with no subsidy
from the City for these components of the operations. The Diocese has a large
and professional staff; its records are fully automated and can serve the
Pleasanton site from its existing Cemetery operations in Livermore, Hayward and
Lafayette. The agreement's structure affords the City a long-term solution with a
50-year contract with reasonable provisions for termination or amendments.

The City would contract with one or more commercial landscape firms for the
basic care of the Cemetery. This contract would include:

1. Cutting the grass within the Cemetery weekly as specified.

2. Trimming around markers, monuments, coping and curbing as necessary.

3. Sweeping (blowing) paved surfaces.

4. Leaf removal as necessary.

5. General litter removal, floral tribute removals (once unsightly).

6. Appropriate chemical treatments to the lawn areas.

7. Maintenance and operation of the irrigation system.

16
