<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 06-020 <br /> <br />RESOLUTION DECLARING THAT WEEDS, DIRT, RUBBISH, AND <br />REFUSE UPON OR IN FRONT OF CERTAIN DESCRIBED PROPERTIES <br />WITHIN THE CITY OF PLEASANTON CONSTITUE PUBLIC <br />NUISANCES AND THAT THEY BE ABA TED, AND SETTING A PUBLIC <br />HEARING REGARDING THE ABATEMENT <br /> <br />WHEREAS, there is attached hereto and incorporated by reference herein as if fully set forth a <br />list of properties to which this resolution applies; and <br /> <br />WHEREAS, said list of properties specifically sets forth street, lot and block numbers according <br />to the official assessment map for each piece of property; and <br /> <br />WHEREAS, the properties listed have upon, or in front, of them, weeds, as defined by Section <br />3956 1.5 of the Government Code, dirt, rubbish, or refuse; and <br /> <br />WHEREAS, after consideration of evidence, it appears that said weeds, dirt, rubbish, and refuse <br />are a public nuisance in that they constitute a fire hazard, or that said materials are <br />noxious or dangerous, and as such, are detrimental to the health, safety and welfare <br />of the City of Pleasanton and, as such, shall be removed; and <br /> <br />WHEREAS, it appears that the public nuisances referred to herein are recurrent and seasonal in <br />nature; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOL YES <br />AS FOLLOWS: <br /> <br />Section I: That the weeds, dirt, rubbish and refuse upon or in front of the properties <br />described in the list attached hereto and incorporated by reference herein are <br />declared a public nuisance and are to be abated and removed pursuant to the <br />procedure provided by in Section 39560 -39588 of the Government Code. <br /> <br />Section 2: That the public nuisances described herein are of a seasonal and recurrent nature. <br />
