CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> RESOLUTION NO. 93-104 <br /> <br /> RESOLUTION DECLARING ALL PERSONS IN ADDITION <br /> TO VOLUNTEER POLICE OFFICERS WHO PERFORM <br /> VOLUNTARY SERVICE WITHOUT PAY FOR THE CITY OF <br /> PLEASANTON SHALL BE DEEMED CITY EMPLOYEES FOR <br /> PURPOSES OF THE LABOR CODE RELATING TO <br /> WORKERS' COMPENSATION BENEFIT COVERAGE <br /> <br />WHEREAS, many persons provide volunteer services to the City <br /> without pay and there is a possibility that these persons <br /> could be injured while they are volunteering; and <br /> <br />WHEREAS, the Labor Code defines volunteer police officers as <br /> employees for purposes of workers' compensation <br /> eligibility; and <br /> <br />WHEREAS, the City desires to provide workers' compensation <br /> coverage for all other volunteers while they are <br /> performing volunteer services under the City's <br /> sponsorship; and <br /> <br />WHEREAS, the Labor Code states in various sections, including, but <br /> not limited to, S3363.5 (city volunteers), and §3365 <br /> (firefighters), that workers' compensation coverage can <br /> be extended by the City to those volunteers who perform <br /> services without pay provided the City Council adopts a <br /> resolution deeming these volunteers employees of the <br /> City. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: In addition to volunteer police officers, any person <br /> who performs voluntary service without pay for the City <br /> of Pleasanton under its sponsorship shall be deemed to be <br /> a city employee for purposes of the Labor Code relating <br /> to workers' compensation coverage. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br /> <br />
